These Terms of Service ("Terms") govern your access to and use of dormscouter.com and related services (collectively, the "Service"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility and accounts
You must be at least 13 years old to use the Service. If you create an account, you agree to:
- Provide accurate information.
- Keep your password confidential β you are responsible for activity under your account.
- Notify us promptly of any unauthorized use at hello@dormscouter.com.
2. Acceptable use
You agree not to:
- Post content that is false, defamatory, threatening, harassing, obscene, discriminatory, hateful, or otherwise unlawful.
- Post content that infringes anyone's intellectual-property, privacy, or publicity rights.
- Impersonate any person or entity, or misrepresent your affiliation with a school or organization.
- Attempt to probe, scan, or test the vulnerability of the Service, or breach any security or authentication measure.
- Scrape, crawl, or bulk-download content except through published APIs and within posted rate limits.
- Use the Service to send spam, pyramid schemes, or unsolicited advertising.
- Upload malware, exploits, or any code designed to interfere with the Service.
- Interfere with or disrupt the Service, servers, or networks connected to it.
We reserve the right to remove content, suspend accounts, and cooperate with law enforcement in response to violations of these rules.
3. User content
What you post
You are solely responsible for any content you submit β reviews, photos, comments, tips, corrections, and anything else ("User Content"). You represent and warrant that:
- You own or have the right to submit the content.
- Your content does not violate these Terms or any applicable law.
- You do not post confidential information about other people (including but not limited to roommates' full names, contact details, or disciplinary history).
License you grant us
By submitting User Content, you grant DormScouter a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, modify, display, distribute, and create derivative works of your content for the purpose of operating, promoting, and improving the Service. This license is irrevocable for content that has been publicly displayed on the Service, but you can always delete your own content β removal from public view is effective immediately.
Moderation
We review submissions before they appear publicly. We may accept, reject, edit for clarity, or request changes at our discretion. We are not obligated to publish any submission.
4. Intellectual property
The DormScouter name, logo, site design, code, and all non-user content are the intellectual property of DormScouter or its licensors and are protected by copyright, trademark, and other laws. Nothing in these Terms grants you any right to use these assets except as necessary to use the Service.
User Content remains the property of its author, subject to the license granted above.
5. Copyright and takedowns (DMCA)
We respect intellectual-property rights. If you believe content on the Service infringes your copyright, send a takedown notice to dmca@dormscouter.com with:
- A description of the copyrighted work you claim has been infringed;
- The URL of the content you want removed;
- Your contact information;
- A statement that you have a good-faith belief the use is unauthorized;
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner;
- Your physical or electronic signature.
6. Third-party links and services
The Service may link to third-party websites or services we don't control. We are not responsible for their content or practices. Your use of third-party sites is at your own risk and governed by their own terms and privacy policies.
7. Termination
By you. You can stop using the Service at any time. You can delete your account from Profile β Settings β Delete account, which begins a 7-day cooling-off period during which you can cancel the request. After 7 days the deletion runs automatically and is permanent. See our Privacy Policy for the full list of what is destroyed and what remains.
By us. We may suspend or terminate your account at our discretion β with or without notice β if you violate these Terms, if we suspect fraud or abuse, if required by law, or if we believe your continued use of the Service poses a risk to other users or to DormScouter. When we terminate an account for cause, we record the reason in our internal audit log, which we keep for up to 3 years to prevent repeat abuse and to defend against legal claims. We may, but are not required to, give you advance notice of termination.
What survives deletion or termination. Account deletion or termination does not waive any obligations you have already incurred under these Terms β for example, the license you granted us in Section 3 covers contributions that were publicly displayed before deletion. Your public contributions remain on the Service attributed to "Anonymous" rather than to you. Sections of these Terms that by their nature should survive termination (including licenses, disclaimers, limitations of liability, indemnification, and governing law) will survive.
Re-registration. If your account was terminated for cause, you may not create a new account without our written permission. Attempting to evade a termination by registering a new account is itself a violation of these Terms.
8. Disclaimers
The Service and all content on it are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted or error-free.
User Content reflects the opinions of its authors. We make no warranty as to the accuracy, completeness, or reliability of any review, rating, photo, or other user-submitted material. Verify anything important with your housing office before making a decision.
9. Limitation of liability
To the fullest extent permitted by law, DormScouter and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill arising from your use of the Service β even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed one hundred U.S. dollars ($100).
10. Indemnification
You agree to indemnify and hold harmless DormScouter and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms.
11. Governing law and venue
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced on the home page and through the email associated with your account. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, are the entire agreement between you and DormScouter regarding the Service.
- Severability. If any provision is held unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
- Assignment. You may not assign these Terms without our prior written consent. We may assign them freely.
